December 2024 Employment Law Update

—NELGPC prepared and presented an Employment Law Update for the Greater Merrimack Valley Human Resource Association meeting today.   Topics included the status of the FTC Noncompete Rule and action items for employers in the interim pending the appeal; the status of the US—DOL FLSA Salary Threshold Final Rule and addressing the July wage adjustment roll-back; a new US—DOL Proposed Rule eliminating  employment of disabled individuals at a lower wage rate under Section 14(c) of the FLSA; the recently enacted —Massachusetts Pay Transparency law; updates regarding the Massachusetts Paid Family and Medical Leave Act including a recent Massachusetts SJC Decision finding that MA PFML does not require the “accrual” of benefits while on leave; a recent Massachusetts Appellate Division Decision regarding “retention bonuses” under  the Wage Act; —beginning fall out of the demise of Chevron deference under Supreme Court’s decision in Loper Bright; anticipated changes at the NLRB and challenges to the NLRB’s authority in the incoming Trump Administration; Trump’s Nominee for Secretary of Labor; and trending state laws and SHRM initiatives.
