March 2026 Employment Law Update

Debra Dyleski-Najjar, Esq. presented her monthly legal update on March 5 as Legislative Director of the Greater Merrimack Valley Human Resource Association.  Topics covered in the March legal update included the new proposed DOL Independent Contractor Rule, the NLRB joint employer definition, EEOC guidance on “remote work” accommodations, applying ERISA forfeitures consistent with plan sponsor’s fiduciary duties, a new challenge to the Massachusetts Wage law allowing monthly payment of wages to exempt employees, and the first court decision finding that Generative AI searches are not protected by the attorney-client privilege.
