Debra Dyleski-Najjar, Esq. presented her monthly legal update on November 6 as Legislative Director of the Greater Merrimack Valley Human Resource Association. Debra’s presentation included a discussion of a recent decision finding a retention bonus was not a “wage” for purposes of the MA wage act, another recent case discussing whether AI in hiring is subject to the lie detector statute, two DOL opinion letters regarding counting overtime hours for FMLA purposes and “horizontal joint employers,” as well as recent immigration developments, the new Roth catch up provisions for Highly Paid Individuals aged 60-63, and an EEOC suit under the Pregnant Workers Fairness Act.
